Two charged with cocaine offenses

Friday, Sept. 11, 2009

Two St. Mary's men were arrested Wednesday on felony drug charges in court papers alleging that a plastic bag of cocaine was found on the ground next to a vehicle parked at a Lexington Park motel.

Jeffrey K. Berry, 51, of Lexington Park and Harry R. Frederick, 36, of Great Mills were released Thursday morning on personal recognizance to await a court hearing on charges including the possession of cocaine with the intent to distribute. Berry also was charged with driving with a suspended license.

St. Mary's sheriff's Sgt. Eric Walker filed charging papers stating he saw two people, including Berry, seated in a vehicle in the Day's Inn parking lot, and that Frederick approached the side of the vehicle.

Berry passed something to his passenger, who dropped it outside the car window before Frederick bent down to pick it up, according to charging papers. The deputy saw a plastic bag of cocaine on the ground, charging papers state, and the officer was trying to detain Frederick when the vehicle's passenger got out and ran away.

The deputy arrested Berry and Frederick as other law officers arrived to assist, court papers state, and another plastic bag later was found underneath the vehicle.

"The quantity of cocaine in the baggies recovered shows a clear intent to distribute and would not be a usual amount for a user," Walker wrote in a statement of probable cause.
